How Long before Demerit Points Return

Morning all,

I got a speeding fine in October 2007, just wondering how long before the demerit points return. This is in Queensland.

Is it;

1 point a year

Or all points after 1 year

Or all points after 3 years et

Not sure on Queensland but here in Adelaide it is all points back after 3 years

OK you have 0 points to start and incur demerit points. ie you don't lose points you actually acumulate them.

If you incur 2 points in 2007, 3 points on 2008, you will then have the 2 demerits removed on 2010 and 3 points removed in 2011. Meaning you will have demerit point removed pregressively thee years after they were incured.

You have no idea how many arguments I've had about this. It is a bit pedantic but it's all in the name really isn't it.

I was led to believe that you wipe off the demerit points for each individual infringement 3 years after that infringement. If you have 11 demerits from separate infringements you don't wipe them all after 3 years, only the infringement you incurred 3 years ago.

You get your points 3 years from the date of paying your fine. If you have not lost any points from when you had your learners till an open licence, you have 12 points. You don't add your points, you lose them from the 12.

You're right about the payment of the fine being the date where you count 3 years, but you don't subtract demerits points - you add them.

You start with 0 demerit points and for a full licence holder, if you reach 12 - expect a court date.

I'm almost certain that it used to be the other way around many years ago but that's the way it is today.

If we had a certain number of points, lost them for offenses and gained them back after a number of years then they would be called merit points, not demerit points.

Not sure about a court date, in NSW the RTA just send a letter saying your licence will be cancelled on a certain date and not to drive after that, but you can go to the RTA and apply to have a retricted licence for a period of 12months or just have yours cancelled for 3 months and get a full brief back with all points

You get points, you don't start with 12 points and then lose them. the record for number of points I've heard of someone having is 23.

"you are only aloud to accumulate 1 demerite point during the 1 year good driving behaviour period"

In all states they work the same in all respects BAR 1. Some states you start with 12 and lose points for an infringement, and other states you start with 0 and are not aloud to accumulate more than 12. For this purpose it really does matter what state you are in.

However, all states have the same 3 year policy, 3 years after the infringement (not paying the fine, the infringement) your points are returned to the prior infringement status

Perhaps that also changes from state to state.

How long does it take for demerit points to show on my record?

The RTA will be advised of the offence and add the demerit points after you pay the fine to the State Debt Recovery Office (SDRO), or if you do not pay the fine, when an enforcement order is made by the SDRO for collection of the fine. If the offence is heard by a court, after the court determines the matter.

I hate to disappoint all the NSW members, but it is not 3 years but actually 40months before the points are taken off your record.

it is on the RTA website,but you have to really go looking for it.

And the points are added from the date of the offence. Then removed 40 months after.

I to thought it was 3 years until I was advised by the RTA. The women even told me that she thought it was 3 years until they recieved a memo stating the 40 months.

Demerit points and licence suspensions

The law requires the RTA to send a notice of suspension to a licence holder who has incurred 12 or more demerit points in any three-year period.

The law permits the counting of demerit points for offences of any age but suspension can only be applied if the dates the offences were committed are within 3 years of each other.

However, the RTA considers it would be unreasonable to consider offences more than 40 months old. The 40-month period exists to ensure that delays between an infringement taking place and the RTA being notified of the infringement are taken into account and ensures that only recent and relevant offences are counted.

For this reason, demerit points up to 40 months old are displayed on the RTA’s online demerit point enquiry screen, because these offences have the potential to count towards a demerit point licence suspension.

Demerit points used towards a licence suspension can’t be counted towards future licence suspensions.

Note: Offences and the relevant number of demerit points remain on a person’s driving record irrespective of the age of the offence. If you obtain a copy of your driving record, all your offences and demerit points will be displayed because this accurately reflects your driving history.
